That is the standard defense for anyone who sells a virtual product. You are not selling a level 70 Monk with 600 AAs, you are selling the TIME it took to make a monk level 70 with 600 AAs. I'm not condemning or condoning the action, just trying to explain it better than it had been.

And I'm explaining that it is not any less illegal for the rationalization. You are recieving money to transfer a specifically non-transferrable licsense. That's Fraud. It doesn't matter how many hours you put into it, the licsense itself which allows you to interact with that account is specifically non-transferrable. You are specifically prohibited from doing so. The time you put into it may or may not have value, however it is impossible to cash in on that value without breaking the EULA and committing fraud by transferring a non-transferrable licsense.
Another facet that is unique to the gaming world is the retroactive change to items. As a game patch comes in, some items gain or lose their value due to changes, either in stats or in the ability to combine those items. Also the rarity of the item can change overnight (as that is when patches are done). This makes the marketplace very uncertain and causes quite a bit of discussion here.
