This item now has a required (not recommended) level of 60.
I certainly hope that this is a coding mistake by SOE that will be corrected in the next patch. This item has been in the game for over a year, there are hundreds (probably thousands) in use by characters under level 60. While it is a bit overpowered for a newbie character, it is not that far above what is available in other areas and is certainly underpowered compared to most items with a required or recommended level of 60.
If the whip is left with a high recommended or required level, it needs an upgrade in the stats/hp/resists. The limited stats on the item already hurt its popularity with players and without an upgrade in this area, the new level would make it completely worthless.
